PRIVACY and TERMS OF USE AGREEMENT

By using the Evoke News Opportunity services (hereinafter known as “the Service”), you accept and agree to the terms contained hereunder. The terms of this agreement apply to all users, and all users are entirely liable for all activities conducted. The following agreement is subject to change periodically and it is your responsibility to remain current with the latest terms.

Job Posting Duration

Evoke News will remove job postings over 30 days old, and shall have the right, but not the obligation, to monitor postings to determine compliance with this agreement and any other operating rules established by us. We shall have the right in our sole discretion to edit, refuse to post or remove any material submitted to or posted on the service. Without limiting the foregoing, we shall have the right to remove any material that we, in our sole discretion, find to be in violation of the provisions hereof, otherwise objectionable or stale. Notwithstanding this right, users shall remain solely responsible for the content of their messages.

Personal Information

Registering for the Service requires that you provide the requested contact and general information. We may use the information collected during the registration process to occasionally notify you about important functionality changes to the Web site or new services from Evoke News. We do not sell or otherwise transfer e-mail addresses or other general information. Evoke News may disclose your personally identifiable information if we believe in good faith that we are required to do so in order to comply with applicable law, a subpoena or other legal process. We may also disclose this information if we have reason to believe that disclosing this information is necessary to identify, contact or bring legal action against someone who may be violating our terms of service or to protect the safety of our users and the public.

Disclaimer of Warranty; Limitation of Liability

Each user expressly agrees that use of the Service is at his or her sole risk. We do not warrant that these services will be uninterrupted or error free; nor do we make any warranty as to the results that may be obtained from use of these services or as to the accuracy, reliability or content of any information provided through the service. The disclaimer of liability contained in this section applies to any damages or injury caused by any failure of performance, error, omission, interruption, deletion, defect, delay in operation or transmission, computer virus, communication line failure, theft or destruction or unauthorized access to, alteration of, or use of record, whether for breach of contract, negligence, or under any other cause of action. Each user specifically acknowledges that we are not liable for the defamatory, offensive or illegal conduct of other third parties, subscribers, or other users of the Service and that the risk of injury from the foregoing rests entirely with each user. In no event will we or any person or entity involved in creating, producing or distributing the service be liable for any direct, indirect, incidental, special or consequential damages arising out of the use of or inability to use the Service or out of the breach of any warranty. Under no circumstances will we be liable for any loss or damage caused by reliance on information obtained through postings on the service.
